6. Breaking the Fast before the certainty of sunset.

It came in the Saheeh of Muslim (1) from the Hadeeth of Umar Ibn Al-Khaṭṭāb رضى الله عنه, who said, that the Messenger of Allaah صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ said:

"إِذَا أَقْبَلَ اللَّيْلُ مِنْ هَاهُنَا، وَأَدْبَرَ النَّهَارُ مِنْ هَاهُنَا، وَغَرَبَتِ الشَّمْسُ، فَقَدْ أَفْطَرَ الصَّائِمُ".

"When night approaches from this side here and the day vanishes from this side here and the sun sets, then the fasting person should break his fast."


Commentary:

The hadeeth points to the fact that these attributes should be considered all together in regards Breaking the fast; so that the people don't break their fast before the certainty of sunset.

As-Son'aanee رحمه الله said: regarding his صلى الله عليه وسلم statement:

إِذَا أَقْبَلَ اللَّيْلُ مِنْ هَاهُنَا
When night approaches from this side here

Hunaa (هنا) is a Noun of place while haa(ها) is a particle of notification which points to the direction of sunrise, because it is from it the night approaches.

his صلى الله عليه وسلم statement:

وَأَدْبَرَ النَّهَارُ مِنْ هَاهُنَا
And the day vanishes from this side here

This points to the direction of the sun set, because it's from it the night vanishes, with the vanishing of the sun.

his صلى الله عليه وسلم statement:

وَغَرَبَتِ الشَّمْسُ
and the sun sets

The explanation of the vanishing of the day

his صلى الله عليه وسلم statement

فَقَدْ أَفْطَرَ الصَّائِمُ
then the fasting person should break his fast.

That is: the entry of the period of breaking the fast shar'an (legislatively), because it doesn't have the ruling of holding off during the night.
